Expert Witness
Development Impact Assessment
We were engaged by Central Coast Council to provide expert witness testimony to the Land and Environment Court in relation to a Development Application for a 53 room Boarding house.
It was a complex proposal as the land was flood affected and contained existing significant trees. We undertook an Arboricultural Impact Assessment and determined that the extent of new development would not be sustainable for the existing trees.
We attended lengthy and prolonged joint witness conferencing with the Developer’s Arborist along with the respective landscape architects, flood & civil engineers in an attempt to balance the interrelated issues of flood mitigation, tree retention and other planning issues.
Subsequently we were required to attend court and take the witness stand as an expert witness where cross examination by barristers from both sides was undertaken to further understand the outcomes detailed in the Joint Witness Statement.
Scope:
- Residential Boarding House Building Development
- Review of Statement of Facts and Contentions
- Arboricultural Impact Assessment
- Joint Witness Report preparation
- Integrated assessment between Civil, Hydraulic, Landscape and Arborist Experts
- Attend Land and Environment and cross examined as expert witness
